Corporate Apiary Agreement
Corporate Apiary Program · Sponsorship TermsThe Sponsor's hive is installed and managed by Buddha Bee at a designated apiary site (the "Apiary Site"). Buddha Bee maintains all necessary site access and authorization to install, inspect, and manage the hive(s) on the Sponsor's behalf — the Sponsor has no obligation to arrange or grant property access. The Sponsor may arrange visits to the Apiary Site with at least seven (7) days' advance notice to Buddha Bee, subject to availability and reasonable scheduling.
Buddha Bee provides full-service hive management as part of the Corporate Apiary program. This includes routine inspections; disease prevention, diagnosis, and treatment; varroa mite testing and treatment; swarm management; queen replacements; and supplemental feeding.
While Buddha Bee applies its expertise to maintain healthy colonies, bee colony health is influenced by factors beyond anyone's control. Unless caused by the Sponsor's gross negligence, willful misconduct, or a natural disaster, Buddha Bee will replace a dead or failing colony as soon as reasonably possible at no additional charge.
The Sponsor will receive email notification at least seven (7) days before each scheduled inspection. If the Sponsor wishes to attend but cannot make the scheduled time, Buddha Bee will make reasonable efforts to reschedule — however, inspections are not performed on weekends and rescheduling cannot always be guaranteed given the time-sensitive nature of beekeeping. Following each inspection, Buddha Bee will send a hive health update by email or text.
Once your hive(s) have sufficient honey to harvest, Buddha Bee will extract and bottle it in labeled containers. Honey from your hives is never mixed with honey from other hives — what your bees make is exclusively yours.
Buddha Bee guarantees a minimum of 1.5 gallons of raw honey per hive, per season, beginning after the initial twelve (12) month term. Honey yields are naturally variable, depending on weather, queen health, local forage, and colony strength. If your hive(s) fall short of the guaranteed amount in any season, Buddha Bee will supplement with honey from another local hive or source.
This Agreement is binding for an initial term of twelve (12) months from the date of installation. After the initial term, the Agreement automatically converts to a month-to-month arrangement, unless the Sponsor provides written notice of intent to terminate at least thirty (30) days before the end of the initial term.
After the initial 12-month term, the Sponsor may terminate this Agreement at any time by providing Buddha Bee with thirty (30) days written notice. The Sponsor may not terminate during the initial term.
If exigent circumstances require early removal of the hive(s), the Sponsor must immediately notify Buddha Bee and agrees to pay: (i) all fees owed at that time; (ii) all fees that would have been collected for the remainder of the initial term; and (iii) an early termination fee of $250 for hive removal. Buddha Bee reserves the right, but has no obligation, to waive any portion of these fees.
Honey bees are not generally aggressive unless provoked, but they can sting — and bee stings can be life-threatening for individuals with severe allergies. Buddha Bee maintains full responsibility for professional colony management and hive safety at the Apiary Site during all scheduled visits and operations.
The Sponsor acknowledges that honey bee hives carry inherent risks. To the extent the Sponsor or any guests arranged by the Sponsor voluntarily visit the Apiary Site, the Sponsor accepts responsibility for ensuring those individuals are made aware of the risks associated with being in proximity to live bee colonies. The Sponsor is not responsible for bee stings or incidents involving third parties who were not invited to the Apiary Site by the Sponsor, nor for any complaints or regulatory actions arising from the operation of hives at the Apiary Site.
Sponsor hereby irrevocably and unconditionally releases, acquits, and discharges Buddha Bee and its respective agents, managers, members, officers, employees, representatives, suppliers, partners, volunteers, affiliates, successors, and assigns (collectively, "the Released Parties") from any and all claims, demands, causes of action, damages, obligations, costs, expenses, attorneys' fees, losses, and liabilities arising out of or related in any way to the Sponsor's voluntary participation in the Corporate Apiary Program — including any voluntary visits to the Apiary Site — whether existing now or arising in the future, including without limitation: (i) death, personal injury, or loss of any kind sustained during the Sponsor's voluntary participation; (ii) injuries sustained as a result of the negligence of the Released Parties during such voluntary participation; or (iii) any claim arising under any federal, state, or local law.
This release does not apply in the case of gross negligence, willful misconduct, or fraud on the part of the Released Parties.
The Sponsor represents and warrants that it has adequate liability or medical insurance to cover any possible injury, loss, or damages that may occur in connection with the Sponsor's voluntary participation in the Corporate Apiary Program, including any visits to the Apiary Site, and agrees to cover any such costs not paid for by insurance.
The Sponsor agrees to defend, indemnify, and hold the Released Parties harmless from and against all claims arising out of or related to the Sponsor's voluntary participation in this program or any visits to the Apiary Site arranged by the Sponsor — unless such claims arise directly from the Released Parties' own gross negligence, willful misconduct, or fraud.
This Agreement is governed by the laws of the State of North Carolina. The Sponsor consents to the exclusive jurisdiction and venue of the state and federal courts in Orange County, North Carolina for any dispute. If any provision is found void or unenforceable, the remaining provisions remain in full force and effect. The waivers, releases, assumptions of risk, and indemnifications in this Agreement survive termination.
By checking the agreement box and completing payment on the Buddha Bee Corporate Apiary pricing page, the Sponsor represents that they have read, understood, and voluntarily agreed to each of the terms set forth in this Agreement. This electronic acceptance constitutes a legally binding agreement equivalent to a written signature.
Buddha Bee has not made and the Sponsor has not relied upon any representations, statements, or inducements apart from the terms of this Agreement.
