Corporate Apiary Agreement
Professionally managed honey bee colonies, installed and maintained on-site at your property. Please read these terms in full — accepting them at checkout makes this a binding agreement.
A note before the legal bit
Welcome to the apiary.
Thank you for inviting us — and a colony of around fifty thousand honey bees — onto your property. This agreement spells out what you can expect from us and the handful of things we'll ask in return. We've written it in plain English wherever we can; where the language turns formal, it's because those parts matter most. If anything is unclear, tell your beekeeper — that's faster than emailing a lawyer.
1 What We Provide
Buddha Bee provides full-service hive management as part of our Corporate Apiary program. That includes routine inspections; disease prevention, diagnosis, and treatment; varroa mite testing and treatment; swarm management; queen replacements; and supplemental feeding. Our beekeepers visit every 2 to 4 weeks during the active season, and as conditions require through winter.
While we apply our expertise to keep colonies healthy, bee health depends on factors no one fully controls. Unless caused by the Host's gross negligence, willful misconduct, or a natural disaster, Buddha Bee will replace a dead or failing colony as soon as reasonably possible at no additional charge.
2 Scheduling & Hive Updates
The Host will receive at least seven (7) days' email notice before each scheduled inspection. Inspections are not performed on weekends. If the Host would like to attend but cannot make the scheduled time, Buddha Bee will make reasonable efforts to reschedule — though beekeeping is time-sensitive and rescheduling cannot always be guaranteed.
Following each inspection, Buddha Bee will send a hive status update by email or text. For the quickest reply, text your beekeeper.
3 Access to Your Property
The Host grants Buddha Bee, its agents, and employees access to the Hive Site to install and manage the colonies at reasonable hours, with at least seven (7) days' advance notice once installed. The Host is responsible for providing a suitable, safe hive location and for keeping the access path clear; Buddha Bee will string-trim the surrounding ten (10) foot area around the hive(s) at each visit.
If the Hive Site requires check-in, badging, escort, or other site-access procedures, the Host will share them with Buddha Bee in advance so visits can proceed as scheduled.
Please notify Buddha Bee before applying pesticides, herbicides, or fungicides within roughly one hundred (100) feet of the hives, and ask neighbors and contractors to do the same where possible — bees forage up to several miles.
4 Your Honey
Once a hive has produced enough honey to harvest, Buddha Bee will extract and bottle it in labeled containers, which can be branded for the Host on request. Honey from the Host's hives is never mixed with honey from other hives — what the Host's bees make is exclusively the Host's.
5 Honey Guarantee
Buddha Bee guarantees a minimum of 1.5 gallons of raw honey per hive, per season, beginning after the initial twelve (12) month term. Honey yields are naturally variable — they depend on weather, queen health, local forage, and colony strength. If the Host's hives fall short of the guaranteed amount in any season, Buddha Bee will supplement with honey from another local hive or source.
6 Photography & Publicity
This Agreement covers the installation and management of honey bee colonies only. Any photography, marketing, social media, co-branding, or other promotional use of the colonies, the Hive Site, or the partnership is not included here and will be governed by a separate written agreement.
Buddha Bee will not identify the Host or use images of the Hive Site for marketing without the Host's prior written consent.
7 Fees & Payment
Fees, the number of colonies, and equipment selections are as identified at checkout. Year 1 includes a one-time setup and installation charge plus annual colony management; each year thereafter is billed as annual management only, with no setup fee.
Invoices are due on receipt unless otherwise stated at checkout. Accounts thirty (30) or more days overdue may result in suspension of service or removal of the hive(s) until the account is current. Buddha Bee accepts ACH bank transfer or credit/debit card; any processing fees are shown at checkout.
8 Adding or Adopting Colonies
Additional colonies. The Host may request additional colonies at any time, subject to availability. Each additional colony carries the applicable setup fee plus an added management fee, quoted at the time of request.
Colony adoption. After the initial term, the Host may take full ownership and management of its hive(s) for a one-time adoption fee of $195 per hive. Upon adoption, the Host assumes full responsibility for the hive and ownership of the bees and the following equipment, per hive:
- One (1) deep box with eight (8) deep frames
- One (1) division board feeder
- Three (3) medium honey supers with thirty (30) medium frames
- One (1) queen excluder, one (1) bottom board, one (1) top cover, and one (1) hive stand
9 Term, Renewal & Termination
This Agreement is binding for an initial term of twelve (12) months from the date of installation. The Host may not terminate during the initial term. After the initial term, the Agreement converts to a month-to-month arrangement, and either party may terminate at any time with thirty (30) days' written notice.
If exigent circumstances require early removal of the hive(s) during the initial term, the Host must notify Buddha Bee immediately and agrees to pay: (i) all fees owed at that time; (ii) all fees that would have been collected for the remainder of the initial term; and (iii) a $250 hive-removal fee. Buddha Bee reserves the right, but has no obligation, to waive any portion of these fees.
10 Bees, Risk & Assumption of Risk
Honey bees are not generally aggressive unless provoked, but they can sting — and bee stings can be life-threatening for individuals with severe allergies. Neither Buddha Bee nor its agents, contractors, partners, employees, or representatives shall be held liable for any injuries arising from bee stings.
The Host acknowledges that hosting honey bee hives carries inherent risks, including the possibility of serious injury or death, and accepts full responsibility for any risks, injuries, or damages — known or unknown — to the Host, its employees, contractors, and invitees arising out of or related to the presence or management of honey bee colonies at the Hive Site, including any physical contact with honey bees. The Host is responsible for making its employees, contractors, and guests aware of the colonies and the associated risks, and accepts responsibility for any complaints, claims, or actions from neighbors or government authorities arising from the hive(s).
Buddha Bee maintains full responsibility for professional colony management and hive safety at the Hive Site during its scheduled visits and operations.
11 Waiver & Release of Liability
The Host irrevocably and unconditionally releases, acquits, and discharges Buddha Bee and its agents, managers, members, officers, employees, representatives, suppliers, partners, volunteers, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, obligations, costs, expenses, attorneys' fees, losses, and liabilities arising out of or related in any way to the Host's participation in the Corporate Apiary Program or the Released Parties' access to the Hive Site — whether now existing or arising in the future — including without limitation: (i) death, personal injury, or property damage; (ii) injuries sustained as a result of the negligence or strict liability of the Released Parties; or (iii) any claim arising under any federal, state, or local law.
This release does not apply in cases of gross negligence, willful misconduct, or fraud on the part of the Released Parties.
12 Insurance & Indemnification
Buddha Bee carries commercial general liability insurance with limits of $1,000,000 covering its beekeeping operations at the Hive Site. A Certificate of Insurance naming the Host as an additional insured is available on request.
The Host is responsible for maintaining its own commercial property and liability insurance appropriate to its premises, employees, and guests — Buddha Bee's coverage protects its work, not the Host's property or personnel.
The Host agrees to defend, indemnify, and hold the Released Parties harmless from and against all claims arising out of or related to the Host's participation in the Corporate Apiary Program or the Released Parties' access to the Hive Site — unless such claims arise directly from the Released Parties' own gross negligence, willful misconduct, or fraud.
13 Governing Law & Final Provisions
This Agreement is governed by the laws of the State of North Carolina. The Host consents to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, North Carolina for any dispute. If any provision is found void or unenforceable, the remaining provisions remain in full force and effect. The waivers, releases, assumptions of risk, and indemnifications in this Agreement survive termination. This Agreement is the entire understanding between the parties; any changes must be in writing and agreed to by both.
14 Acceptance
Clickwrap acceptance
By checking the agreement box and completing payment on the Buddha Bee Corporate Apiary checkout page, the Host represents that it has read, understood, and voluntarily agreed to each of the terms set forth in this Agreement, and that the individual accepting is authorized to bind the Host. This electronic acceptance constitutes a legally binding agreement equivalent to a written signature.
Buddha Bee has not made, and the Host has not relied upon, any representations, statements, or inducements apart from the terms of this Agreement.
